NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF TRAVIS HERNANDEZ D/B/A INSTINCT FOOTBALL 954 USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM TRAVIS HERNANDEZ D/B/A INSTINCT FOOTBALL 954 IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND TRAVIS HERNANDEZ D/B/A INSTINCT FOOTBALL 954 HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

1. Activity

The activity is football skills training provided by Travis Hernandez, doing business as Instinct Football 954 (the “Provider”), including 1-on-1 sessions, small group sessions, kicking sessions, conditioning, and related drills, held at outdoor public and private fields in Broward and Palm Beach Counties.

2. Inherent risks

Inherent risks are dangers or conditions, known or unknown, that are characteristic of, intrinsic to, or an integral part of the activity and that are not eliminated even if the Provider acts with due care in a reasonably prudent manner. For football training they include, but are not limited to:

  • Contact with other athletes, the ball, equipment, cones, sleds, or the ground
  • Sprains, strains, fractures, dislocations, cuts, bruises, and concussions
  • Running, cutting, jumping, and catching at full speed
  • Heat-related illness, dehydration, sun exposure, and insects
  • Uneven, wet, or artificial playing surfaces
  • Sudden weather changes, including lightning
  • Physical exertion that may reveal an unknown medical condition
  • The failure of the Provider to warn the natural guardian or minor child of an inherent risk
  • The risk that the minor child or another participant may act in a negligent or intentional manner and contribute to the injury or death of the minor child

3. Release

In consideration of my child being allowed to participate, I, the parent or legal guardian, on behalf of myself and my child, waive and release, in advance, any claim or cause of action against the Provider, and the Provider’s affiliates, employees, and agents, for personal injury, including death, or property damage that would arise from the inherent risks of the activity, to the extent allowed by Florida Statute 744.301(3). This release does not apply to injuries caused by the Provider’s negligence.

4. Medical authorization

If my child is injured or becomes ill and I cannot be reached, I authorize the Provider to call emergency medical services and to arrange emergency treatment for my child. I am responsible for the cost of any treatment.

5. Health

I confirm my child is physically able to take part in football training. I have listed on this form any medical condition, allergy, or injury that a coach or first responder should know about, and I will tell the Provider before a session if that changes.

6. Rules and conduct

My child will follow the coach’s instructions, including stopping when told. The coach may end a session or remove an athlete for safety, weather, or conduct.

7. How long this waiver lasts

This waiver covers every session my child attends with the Provider during the 12 months after the date I sign it. If the Provider changes the terms of this waiver, I will be asked to sign the new version before my child’s next session.

8. Electronic signature

I agree to sign this form electronically. Typing my full legal name and selecting “Sign waiver” is my signature and has the same effect as a handwritten signature. I will receive a copy of the signed form by email.

The waiver above updates to match the athlete's age.
